Terms of Service

1. Parties and acceptance

These terms govern your use of the Yakınım mobile app and the pages at yakinim-5850a.web.app (the "Service"). The Service is provided by the developer of Yakınım ("Yakınım", "we", "us"). By installing or using the app you accept these terms and the Privacy Policy. If you do not accept them, do not use the app.

2. The Service

Yakınım lets small groups such as families come together with an invite code, lets members share their live location with the group if they choose to, sends safe zone entry/exit notifications, shows route and event history, and lets members send an SOS alert within the group. Some features require the paid Yakınım Plus subscription.

3. Accounts and eligibility

• The app works with an anonymous account created on your device. No name, email address or password is required.
• The anonymous account is tied to the device. Deleting the app, resetting the device or switching devices may cause you to lose access to your account and groups, and we may not be able to restore that data.
• Children under 13 may use the app only with the knowledge and supervision of a parent or guardian. A parent or guardian who sets up the app for a minor is responsible for compliance with these terms.
• You are responsible for the security of your device and account.

4. Consent and location sharing

• Location sharing is off by default and can only be turned on by the person using the device.
• You may use Yakınım only with the knowledge and consent of the people whose location you want to see. Installing the app on someone else's device without their knowledge, secretly turning on location sharing, or using the app to stalk, harass or control anyone is strictly prohibited and may be unlawful.
• Use the location, zone and event information of group members only within the group and for personal and family purposes; do not share it with third parties by screenshot or any other means.
• You can leave a group or turn sharing off at any time.

5. Prohibited use

When using the Service you agree not to:

• Violate applicable law, the rights of others, or the protection of their personal data,
• Use display names, group names or zone names that are insulting, threatening, hateful or impersonate someone else,
• Attempt to bypass the Service's security measures, rate limits or access rules, or try to guess invite codes,
• Use the Service with automated tools, overload it, reverse engineer it (except where permitted by law) or distribute malware,
• Use the Service for non-family purposes such as commercial tracking, employee monitoring or fleet management.

6. Emergencies and accuracy

• Yakınım is not an emergency service. The SOS feature does not call emergency services or notify the police; it only notifies people in your group. In a life-threatening situation, call your local emergency number (112 in Türkiye and the EU, 911 in the US) directly.
• Location information relies on the device's GPS, Wi‑Fi and mobile network signals and may be inaccurate, incomplete or delayed. Battery saving settings, disabled permissions, weak network connections or operating system restrictions can stop or delay location updates and notifications.
• Do not rely on the Service as the only way to keep someone safe.

7. Yakınım Plus subscription

• Yakınım Plus is a paid subscription that adds features to the free plan (for example, 90 days of route and event history instead of 7). The current features, price and subscription period are shown on the purchase screen.
• Payment is charged to your App Store or Google Play account when you confirm the purchase. Purchases are subject to the terms of the respective store.
• The subscription renews automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within the 24 hours before the period ends.
• You can manage your subscription and turn off auto-renewal in your store account's subscription settings. Deleting the app does not cancel the subscription. Cancellation takes effect at the end of the current period; you keep Plus features until then.
• If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription.
• Refund requests are made directly to the App Store or Google Play under their refund policies. Plus features end for subscriptions refunded by the store.
• Prices may change; price changes are announced in advance in line with the store's rules.
• A purchase is linked to the group you select in the app. Which group the Plus features apply to is explained on the purchase screen.

8. Intellectual property

All rights in the app, its design, name, logo and software belong to us. Provided you comply with these terms, you are granted a personal, non-transferable, non-exclusive and revocable licence to use the app on your own devices for personal, non-commercial purposes. Content you enter, such as display names, group names and zone names, remains yours; we process it only to provide the Service.

9. Third-party services

The Service works with third-party services such as Google Firebase, Google Maps, Apple and Google notification services, the App Store, Google Play and RevenueCat. We are not responsible for their outages or their own terms. Apple and Google are not parties to these terms and have no obligation to provide support or maintenance for the app.

10. Changes, suspension and termination

• We may add, change or remove features to improve the Service. If paid features are significantly reduced, we will let you know in advance.
• We may suspend or close, without notice, accounts that violate these terms, put others at risk or harm the Service.
• You may stop using the Service at any time and request deletion of your account as described in the Privacy Policy.

11. Limitation of liability

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free or always provide accurate location information. To the fullest extent permitted by applicable law, we are not liable for indirect damages arising from the use of or inability to use the Service, inaccurate or delayed location information, or notifications that are not delivered. Liability for intent or gross negligence, and your rights under consumer protection law (including Turkish Consumer Protection Law No. 6502), are not affected.

12. Governing law and disputes

These terms are governed by the laws of the Republic of Türkiye. Disputes within the applicable monetary limits are handled by consumer arbitration committees and consumer courts. If you are a consumer living in another country, the mandatory consumer rights granted to you by that country remain unaffected.

13. Changes to these terms

We may update these terms from time to time. For significant changes we will notify you in the app. The current version is always published at this address; continuing to use the Service after a change means you accept the updated terms.
